General and specific powers of attorney
A general power of attorney gives the attorney wide authority, while a specific (or limited) power of attorney authorises particular acts — for example, selling one identified property. For most property transactions, a specific power of attorney is safer: it limits what the attorney can do and is easier for registries and counterparties to rely on.
Signing, registration and use in Kenya
A power of attorney used to deal with registered land in Kenya must be registered before the attorney can rely on it at the land registry, and stamp duty is payable on registration. Powers of attorney are also registered under the Registration of Documents Act where required.
