A constitutional petition is filed in the High Court (Constitutional and Human Rights Division) under Article 22 of the Constitution of Kenya 2010. The petition must identify the specific constitutional right violated, the acts or omissions of the respondent and the relief sought. We draft constitutionally sound petitions, serve respondents and represent petitioners through interlocutory hearings to final judgment.
The High Court may grant declarations, injunctions, compensation, structural interdicts and any other relief that is just and equitable under Article 23 of the Constitution. Where urgent relief is needed, we apply for conservatory orders to preserve the status quo while the petition is determined. The court has wide and flexible remedial powers to address violations effectively.
Judicial review is the mechanism by which the High Court supervises the legality, procedural fairness and rationality of decisions by public bodies. It applies to decisions of government ministries, parastatals, regulatory authorities and any other body exercising public power. It is not an appeal of the merits — the court reviews the decision-making process, not the outcome. We assess the strength of judicial review applications before advising clients to proceed.
Yes. Under Article 22(1) of the Constitution, any person acting in their own interest, or on behalf of another person, a class of persons, or in the public interest, may institute court proceedings for enforcement of fundamental rights. Civil society organisations, advocacy groups and individuals can all file constitutional petitions. We represent both individual and institutional petitioners in Kenya's constitutional courts.
