Our Family Law & Children's Rights Practice
Family law matters require both legal precision and genuine human understanding. WTT Lichuma Advocates LLP brings both. Our team — with deep expertise in children's rights built over decades of advocacy at the domestic, regional and international level — handles divorce proceedings, child custody, maintenance claims, matrimonial property disputes and protection orders with the sensitivity and strategic clarity these matters demand.
Our children's rights practice is led by Senior Partner Mrs. Winfred Osimbo Lichuma, EBS — who was part of the committees involved in drafting the Marriage Act 2014, the Protection Against Domestic Violence Act 2015 and the Female Genital Mutilation Act 2012 — so the team understands how this legislative framework was designed and is meant to work. We apply the best interests of the child as our guiding principle in every matter involving children, whether in court or in mediated settlements.
Beyond litigation, we assist clients with wills, trusts, estate administration and succession planning through our dedicated Trusts & Estate Planning practice — ensuring families are protected both in life and in law. We offer discreet, confidential legal counsel, understanding that family matters often involve deeply personal and emotionally sensitive circumstances that demand a careful and professional approach.

Frequently Asked Questions
Common questions our clients ask about family law & children's rights in Kenya.
Divorce is governed by the Marriage Act 2014. A petition is filed in the Family Division of the High Court citing irretrievable breakdown of marriage. The prescribed facts include adultery, cruelty, desertion, or separation for at least 2 years with consent or 3 years without. We prepare and file the petition, serve the respondent and guide you through every procedural step to the final decree.
Under the Matrimonial Property Act 2013, each spouse's share is based on their respective contributions — both monetary and non-monetary, including domestic work, childcare and career support. Courts often begin from an equal division position in long marriages, departing where contributions are clearly disproportionate. We gather and present evidence to secure your fair share.
Kenya has a comprehensive child protection framework anchored in the Children Act 2022 and the Constitution. Children have the right to parental care, education, health, protection from abuse and exploitation, and to have their best interests prioritised in all decisions affecting them. Members of our firm have been part of the committees involved in drafting several of Kenya's child and family protection laws, and we apply that understanding in every matter involving children.
Kenyan courts apply the best interests of the child as the paramount principle. Relevant factors include the child's age, attachment to each parent, schooling, health and — in older children — the child's own views. Courts prefer joint parental responsibility and structured access where possible. We represent parents in custody applications and help negotiate parenting plans that protect the child and both parents.
