Under Article 65 of the Constitution of Kenya, non-citizens may hold land only on leasehold tenure for a term not exceeding 99 years, and a freehold or longer interest granted to a non-citizen takes effect as a 99-year lease. A company is treated as a citizen for this purpose only if it is wholly owned by Kenyan citizens, and agricultural land is subject to further restrictions under the Land Control Act. We advise on the right structure before you commit funds.
Foreign nationals who wish to engage in business or employment in Kenya need the appropriate work permit under the Kenya Citizenship and Immigration Act 2011. Different permit classes apply to investors in specific trades or businesses, employees with skills not readily available locally, professionals and other categories, each with its own requirements and fees. Not necessarily. Many steps can be completed remotely, and documents signed abroad can be used in Kenya if they are properly executed, notarised and authenticated. A power of attorney can authorise a trusted representative to act on your behalf. We act for diaspora and international clients and coordinate the formalities required.
The Kenya Investment Authority (KenInvest) can issue an investment certificate to qualifying foreign investors under the Investment Promotion Act 2004. Investors who meet the minimum investment threshold can apply, and the certificate can assist with obtaining the licences and permits a project needs. Whether it is worthwhile depends on the size and structure of the investment.
