Our Public Interest Litigation & Dispute Resolution Practice
WTT Lichuma Advocates LLP operates a dedicated litigation and dispute resolution department committed to the efficient and effective resolution of disputes through courts, arbitration and mediation. Our team handles both public interest litigation — where the outcome affects communities, rights or public policy — and private commercial and civil disputes requiring assertive, strategic court representation.
In public interest matters, the firm has a proven track record of advocacy in Kenya's constitutional courts, representing parties in proceedings that shape legal protections for vulnerable groups, gender equality and children's rights. We bring the same rigour and legal depth to every matter — whether a constitutional petition in the High Court, a commercial dispute in the Magistrate's Court, or an international arbitration proceeding.
Our dispute resolution philosophy prioritises the fastest, most cost-effective resolution consistent with protecting our client's rights and interests. We assess every dispute for its mediation and arbitration potential before committing to contested proceedings, and we manage the full life of each case — from pre-action strategy through to judgment, appeal and enforcement.

Frequently Asked Questions
Common questions our clients ask about public interest litigation & dispute resolution in Kenya.
Public interest litigation (PIL) is litigation brought not only to vindicate the rights of a specific party, but to advance justice for a broader class of persons or the public generally. Under Article 22 of Kenya's Constitution, any person can institute PIL proceedings in the public interest. We have extensive experience in PIL — from children's rights to gender-based violence and constitutional governance.
Simple uncontested matters can conclude in 3–6 months. Contested civil cases in the High Court typically take 2–5 years to judgment, depending on complexity. We use every available procedural mechanism — summary judgment, agreed facts, interlocutory applications and consent orders — to manage timelines and control costs.
Yes. Court-annexed mediation is mandatory in certain court tracks under the Civil Procedure Act. Many commercial contracts also include mandatory mediation clauses. Even where not required, mediation typically resolves disputes 70–90% faster than full trial and at significantly lower cost. We advise on when mediation is strategically appropriate and represent clients throughout the process.
Arbitration is a private, binding dispute resolution process where one or more arbitrators hear the parties and issue an enforceable award. It is generally faster and more confidential than court proceedings, with party-appointed arbitrators bringing specialist expertise. Domestic arbitration awards are enforceable as court judgments. We represent parties in domestic and international arbitration across all commercial sectors.
