A conveyancing transaction typically takes approximately 90 days, from instruction to registration of transfer — longer where the title is complex, financing is involved or several parties must give consent. A conveyancing transaction typically takes approximately 90 days, from instruction to registration of transfer, assuming no title complications. Transactions involving financing, subdivision, court orders or regulatory approvals take longer. We set clear timelines at the outset and manage the entire process — searches, sale agreement, stamp duty, registry filing — through to completion.
Stamp duty is 4% of the transfer value for property in municipalities and 2% for rural or non-municipal land. County land rates must also be cleared before transfer. Where the seller is VAT-registered and the property is commercial, VAT at 16% may apply. We advise on the full tax exposure and ensure all instruments are correctly stamped before registration.
Verification involves an official land search at the Lands Registry, a mutation and survey file check, searches for cautions and encumbrances, and confirmation that land rates are cleared with the county government. We conduct all searches, review the title deed and prior transactions, and confirm the property can be lawfully transferred before you commit any funds.
A caution is a registered notice by a person claiming an interest in land. It prevents the Registrar from registering any dealings — including transfers and charges — without the cautioner's consent or a court order. Discovering a caution before paying deposit is critical. We conduct caution searches and advise on whether the caution can be removed before you proceed.
